What is the criteria for getting an administrative review of my child support order?

 

If it has been 36 months since your child support order was issued or modified, you can get an administrative review.

If it has been less than 36 months, you may still be able to get an administrative review based on specific changes of circumstances.  The JFS 01849, "Request for an Administrative Review of the Child Support Order" lists the specific changes of circumstances that qualify a person for an early administrative review.

 

How do I request an administrative review of my child support amount?

To request an administrative review, you must complete the JFS 01849, "Request for an Administrative Review of the Child Support Order", sign the form, and submit the form and any supporting documents to your child support enforcement agency (CSEA).   To request the form, please contact the CSEA at 440-285-9141.  When the CSEA receives your completed request, your caseworker will determine whether your case is eligible for an administrative review.  The CSEA will then notify you that your request is approved or denied.

What information do I need to provide for the child support enforcement agency (CSEA) to complete the administrative review?

Both parties are required to provide the CSEA with evidence of their income, available health insurance, and any other relevant information necessary to properly review the child support order. Contact your CSEA to find out what specific documents you need to provide.

What will the effective date of the administrative review be?

The effective date of the administrative review will be the first day of the month following the review scheduled date.

Will an administrative review also modify my spousal support obligation?

An administrative review will not modify your spousal support obligation. No.  You will need to seek legal assistance to address this.

An administrative review will not modify your ordered payment on arrears.  No.  You will need to seek legal assistance to address this.

How long does the process take?

The administrative review is scheduled out 45 days from the approved request.   Recommendations are issued by mail which provide an objection timeframe of 14 calendar plus 3 business days for court orders and 30 calendar days plus 3 business days for administrative orders.  If a neither party objects an order implementing the results will be issued.  If a party objects, a hearing or hearings may be scheduled which will delay the process.

 

Who pays for administrative review?

If the support order is an administrative order, there is no cost.

If the support order is a court order, the court costs are typically assessed to the requesting party.
